1. Who we are

GuestWave is operated by KS Consulting Services(registration number 2024/862023/07, a private company registered in South Africa; “GuestWave”, “we”, “us”). These Terms govern your use of the GuestWave platform and services. By creating an account, placing an order or using the service, you (“you”, the “Customer”) agree to these Terms.

2. The service

GuestWave is a guest-engagement platform: guests scan a QR code or tap an NFC tag to view menus, connect to WiFi, request assistance, save your contact details, book, or leave a review. We provide the software, and optionally hardware (table talkers, NFC tags) and a 3D virtual tour.

3. Accounts

You must provide accurate account and billing details and keep them up to date. You are responsible for activity under your account and for your login credentials. The account owner controls billing and may add or remove team members.

4. Subscriptions, plans & billing

• Monthly plan — R399 per venue per month, billed month-to-month and renewing automatically each month until you cancel. Paid by card only.
• Annual plan — R2,394 per venue charged up front for the first 12 months, then auto-renewing yearly at R3,830.40 per venue until you cancel. Payable by card or EFT.
• Hardware and once-off items (table talkers, NFC tags, 3D tour) are charged once at the time of the order.
• Payments are processed by Paystack. Card details are handled by Paystack and are never stored by GuestWave. For recurring card plans you authorise the recurring charge described at checkout.

All prices are in South African Rand and include VAT where applicable. Amounts are billed per venue.

5. Price changes

We may change our fees. We will notify you by email at least 30 days before a change takes effect. A new price applies only from your next billing cycle after that notice — we do not re-price a period you have already paid, and an annual term is fixed until its renewal. If you do not accept a change, you may cancel before it takes effect.

6. Cancellation

You may cancel a subscription at any time from your account. Cancellation stops future renewals; your service continues until the end of the period you have already paid for. Except where the law requires otherwise (see our Returns & Refunds Policy), we do not refund the current or an already-paid period.

7. Acceptable use

You must not use GuestWave for unlawful, misleading or infringing content, to send unsolicited messages, or in a way that harms the service or other users. You are responsible for content you publish to guests and for complying with applicable laws, including data-protection and consumer laws.

8. Intellectual property

We own the GuestWave platform and all related intellectual property. You retain ownership of the content you upload (menus, branding, images) and grant us a licence to host and display it to your guests as part of the service.

9. Availability & support

We aim to keep the service available but do not warrant uninterrupted or error-free operation. We may perform maintenance and may update features. Support is provided at hello@guestwave.co.

10. Liability

To the maximum extent permitted by law, GuestWave is not liable for indirect or consequential loss, and our total liability arising from the service is limited to the fees you paid in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under South African law, including the Consumer Protection Act.

11. Suspension & termination

We may suspend or terminate access for breach of these Terms or for non-payment. On termination your right to use the service ends; sections that by their nature survive (for example payment, IP and liability) continue.

12. Privacy

Our handling of personal information is described in our Privacy Policy. Refunds and returns are described in our Returns & Refunds Policy.

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email or on the site, and take effect for continued use of the service.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
